Standard Competition Terms & Condition

All Entrants (“The Players”) to the Smart Piggybank e-gaming prize competition, run by the Smart Play-choice UK Ltd will be deemed to have accepted the following Standard Competition Terms & Condition and agreed to be bound by them, when entering the competition.

1. Information about the Company

  • The Smart Play-choice UK Ltd Company is registered in the United Kingdom, under company number 11265729 with registered office at Suite 2A, Blackthorn House, St Paul’s Square, Birmingham B3 1RL

2. Policies

2.1 In addition to the Smart Play-choice UK Ltd Standard Competition Terms & Condition, the following additional policies also applies to a Players’ use of the website and the Mobile App:

  1. The Privacy Policy, which sets out the terms on which a Player’s personal data is collected and processed. By using the website, a Player warrants that all data provided by the Player is accurate, also consents to its processing.
  2. The Cookie Policy, which sets out information about the cookies on the website.

3.Qualifying Players

3.1 The Smart Play-choice UK Ltd (‘The Promoter’), operates knowledge and skill based e-gaming competition, which results in the allocation of cash prizes in accordance with these terms and conditions on the website and the Mobile App.

3.2 The competition is open to all residents of the United Kingdom aged 16 years or over.

Employees (or family members of employees) of any group company of the Promoter, companies associated with the Smart Play-choice UK Ltd and all affiliates of such companies may not enter this competition.

4. Legal Undertaking

4.1 By entering the competition, a Player will be deemed to have legal capacity to do so. Moreover, the Player would be deemed to have read and understood the terms and conditions and would be bound by them, also by any other requirements set out in any related promotional material.

4.2  The Smart Play-choice UK Ltd will not be held responsible for any Player’s entering any of the e-gaming competition unlawfully. If in any doubt the Player should immediately leave the website or the Mobile App and check with the Smart Play-choice UK Ltd Customer Service.

4.3   All competitions are governed by English Law and any matters relating to the competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.

5. Registration for Entering a Competition 

5.1 All aspiring Players to the competition must register online to create a personal account with the Smart Play-choice UK Ltd to use its Website and Mobile App. For registration to take place, following condition will apply:

  1. No charge is applied for registering to create a personal account
  2. A Player is required to provide his/her full name, date of birth, gender, address of current residence and valid email address.
  3. A Player’s email address could be the unique user name and the password would need to be a minimum of 8 character long including alphanumeric, capital and special characters.
  4. Following registration, using unique user name and secure password, a Player is able to log in via the Company Website, Mobile App, own Facebook account, etc

6. Competition Entry

6.1 When playing a specific game competition, a Player is expected to follow the on-screen instructions:

6.2 A Player wishing to play the game of ‘Spot the position of the invisible ball’ would be required to buy a ticket. The Player would be offered four choices for the purchase of the tickets:

  1. Choice 1, play for one ‘Spot’
  2. Choice 2, play for two ‘Spots’
  3. Choice 3, play for three ‘Spots’
  4. Choice 4, play for four ‘Spots’

6.3 Once the Choice is selected to engage in the number of ‘Spots’ to play, depending on the Choice selected, a Player is able to use his/her skill and judgement to select one, two, three or four ‘Spots’ (X, Y coordinates) on the presented picture (the “Scene”) where the Player thinks the invisible ball should be (each selection being a “Spot”). The Player is able to review and change the selected ‘Spots’ as many times as he/she wishes.

6.4 Once the Player is happy with the selection of ‘Spots’, he/she can proceed to check out and make the required payment via a secure payment method using PayPal, debit or credit card. At this point the Player is prompted to provide his/her contact details and a declaration by ticking a box to confirm that he/she has read and understood the Standard Terms and Conditions.

6.5 A Player will not be deemed to have completed an Entry until payment has been cleared. Once payment is cleared the Player will receive an email confirming his/her Entry.

6.7 The 60% of the amount of money raised from the sale of the tickets is displayed in an online piggy bank (Smartpiggybank) in a picture frame. Each time a person buys a ticket, the amount of money in the Smartpiggybank increase in the displayed picture frame by 60% of the ticket money.

6.8 There is a spend limit for a Player in a specific game competition, which could be once a month or once a week, depending on how long the specific gaming competition has been promoted to last.

7. Competition Period

7.1 Each specific game competition will run for a specified period of time, namely, either one month or a week.  For each competition, details of start and end times and dates would be advertised and promoted well in advance of the competition start date.

8. Competition Judgement

8.1  After the close of the Competition, the X, Y coordinates of the centre position of the invisible ball would be judged by an independent Panel of Judges appointed by the Promoter. Each member of the Panel is an expert in the sporting field, such as a football player and/or a Referee.

8.2 The Judge’s agreed position of the coordinates will automatically be computed against the database of coordinates of all the eligible Entries received in the Competition. If the coordinates of the position of the ball as judged by the Panel of Judges matches or is the nearest to that of a Player’s ticket then that person would be judged as the Winner of the Competition.

8.3 In any Competition, if a case arises, where more than one participant’s ‘Spot’, matches and/or is equidistant to the ‘Spot’ decided by the Judge’s Panel as the Winning ‘Spot’, the Winner will be determined by, whichever participant played and bought the ticket first and other players will automatically become Runners up. The Winner would receive 60% of the money in the Smart piggy bank raised from that specific Competition.

8.4 The next ten (10) Winners (Runner Up’s) of the Competition would receive equal amounts of the remaining 40% of the money in the Smart piggybank.

 9. Winner’s Notification

9.1  The Smart Play-choice UK Ltd will contact the Winner and Runner Up’s, using the telephone numbers and email addresses provided, when registering to entry the competition. It is the responsibility of all Entrant’s to check and update these details each time they enter for a completion. The Smart Play-choice UK Ltd will not be held responsible, if for any reason they are found to be inaccurate.

9.2 If for any reason the Smart Play-choice UK Ltd does not hear from the Winner or any of the Runner Up’s within four weeks of the end of that Competition,in such conditions the Company will award the Prize money to the Entrant with the next closest Spot as the Smart piggybank Competition Winner for that specific game.

10. Winner’s and Runner’s UP Personal Details Check

10.1 Before the prize money is presented, the Smartpiggybank competition Winner and Runner Up will be required to provide and/or produce in person:

  1. A copy of their passport, or any other acceptable form of identity, to confirm their identity and age.
  2. Two proofs of address of residence, such as council tax bill, bank statement or utility bill.
  3. Proof that the credit or debit card used to make payment to enter the competition was legally theirs and/or that they had authorisation to use.

10.2   Failure to meet these obligations may result in the Smartpiggybank Competition Winner or Runner Ups being disqualified and in such conditions the Company will award the Prize money to the Entrant with the next closest Spot as the Smart piggybank Competition Winner and Runner ups for that specific game.

10.3 in the event that the Winner / Runner Up’s being disqualified and in such circumstances, the Company will add their cash price into the Smart Piggybank for the next completion.

  • Following receipt and verification of the details requested above by the Company, the Winners and Runner Up’s will be contacted to attend the prize money presentation event or if there are practical reasons for not being able to attend, then the cheques can be hand delivered or sent by special delivery.
  1. Winner’s and Runners UP Personal Data

11.1   All personal Data of the Entrant’s is used in accordance with the Privacy Policy which is also available on the website.

11.2   It is a condition that the Winners and Runner Ups and their accompanying guests/family must be prepared to make themselves available for the promotional activity in connection with the Competition without any additional remuneration, also the Winner and Runner Ups must agree to the publication of their names in identifying them as a Winner or a Runner Ups of a Competition.  The promotional activity could take the form of a video and/or photographic shoot, which may be used in future marketing and publicity purposes by the Company.

12. Liability

12.1 As a Promoter of the Smart Piggybank e-game, the Smart Play-choice UK Ltd shall not be liable for any loss suffered or sustained to any person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Smart Play-choice UK Ltd, its employees, agents or subcontractors or any other third party involved in the Promotion and/or in connection with presenting the winning prize(s) and, where applicable, to any family/persons accompanying the prize winner(s).

12.2  The Company shall not be liable for any loss of profit, loss of business, business interruption, or loss of business opportunity if anyone other than its employees, agents or subcontractors or any other third party involved in the Promotion, makes use of its Website or Mobile App for any commercial or business purposes.

12.3  The Company shall use its best endeavours to ensure that the software and website used to operate its Competitions perform correctly and accurately across the latest versions of popular Internet, tablet and mobile browsers. However, the Company does not accept any liability for failed, partial or warped transmission for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet, accessibility or availability or for traffic congestion or unauthorised human act.

12.4  The Company will use its best endeavours to award the Prizes for a Competition to the right Winner and Runner up’s. If due to reasons of hardware, software or other computer-related failure, or due to human error any Prize is awarded incorrectly, the Company reserves the right to reclaim the Prize and award it to the correct Entrant, at its sole discretion and without admission of liability.

12.5  The Company shall not be liable for any economic or other consequential loss suffered or sustained to any Entrant receiving the Prize money incorrectly, and no compensation shall be due.

12.6  Under the English law, the Smart Play-choice UK Ltd would however, accept full liability for some things, such as death or personal injury caused by its negligence, or loss caused by a false statement where the statement is made fraudulently and for all matters for which it cannot, exclude or limit its liability.

13. Changes to Terms and Conditions

13.1   The Company at its sole discretion may make changes at any time to these Standard Competition Terms & Conditions without giving prior notice.  It is the responsibility of the Players to check frequently to see any updates or changes to these Standard Terms & Conditions.
